Acceptance of Terms

Newman Family Farm, located in Blaine, Grainger County, Tennessee (referred to as “we,” “us,” or “the Farm”), operates this website and provides related services. These Terms of Service constitute a legally binding agreement between you and Newman Family Farm.

By creating an account, placing an order, or using our website, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our website or services.

Account Registration

  • You must be at least 18 years of age to create an account and make purchases

  • You are responsible for maintaining the security of your account credentials

  • All information provided during registration must be accurate and up to date

  • You are responsible for all activity that occurs under your account

Products and Pricing

  • All prices are listed in US dollars and are subject to change without notice

  • Prices for agricultural products may fluctuate based on seasonal availability, feed costs, and processing schedules

  • Product availability is not guaranteed and may vary by season

  • Deposit-based products (whole or half animals) are priced by estimated weight. The final price is determined by the actual hanging weight at processing and may differ from the estimate

  • Product images are representative and actual products may vary slightly in appearance

Private Membership Association (PMA)

Certain products, including raw dairy items, are available exclusively through our Private Membership Association. Raw dairy products are made available in accordance with Tennessee Code Annotated § 53-3-119, which permits the sale of raw milk directly from the farm to the consumer. To purchase these products:

  • You must sign the PMA waiver agreement before checkout. The waiver is a binding prerequisite for accessing PMA products

  • PMA products are private member-to-member exchanges and are not considered retail sales

  • By signing the waiver, you acknowledge that you understand the nature of these products and assume all associated risks

  • The waiver remains valid until revoked or a new version is published

Ordering and Pickup

  • All orders are pickup only — we do not currently offer shipping or delivery

  • During checkout, you must select a pickup time slot at one of our designated locations

  • Orders must be picked up during your selected time window. If you cannot make your pickup time, please contact us in advance to reschedule

  • Unclaimed orders that are not picked up and for which no contact has been made may be forfeited without refund

  • Some products require advance notice for processing. Lead time requirements are displayed on the product page

Payment

  • All payments are processed securely through Stripe. We never store your credit card information

  • Deposit-based items require a deposit at checkout, with the remaining balance due at pickup based on final weight

Limitation of Liability

To the fullest extent permitted by Tennessee law, Newman Family Farm provides all products on an “as is” basis and disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. In no event shall Newman Family Farm be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our website or products.

Our total liability for any claim arising from your use of our website or products shall not exceed the amount you paid for the specific product in question.

For raw and unpasteurized products available through our PMA, you acknowledge and assume all risks associated with the consumption of these products as outlined in the PMA waiver agreement.

Indemnification

You agree to indemnify, defend, and hold harmless Newman Family Farm, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your breach of these terms, your use of the website, or your violation of any applicable law.

Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of Newman Family Farm and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Dispute Resolution

In the event of any dispute arising from these terms or your use of our services, you agree to first attempt to resolve the matter informally by contacting us in writing. If the dispute is not resolved within thirty (30) days, either party may pursue resolution through the courts of Grainger County, Tennessee. The prevailing party in any legal proceeding may be entitled to recover reasonable attorney's fees and costs.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Grainger County, Tennessee.

Force Majeure

Newman Family Farm shall not be liable for any failure or delay in fulfilling orders or obligations due to circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, livestock disease, processing facility disruptions, government orders or restrictions, pandemics, supply chain interruptions, or other acts of God. In such events, we will make reasonable efforts to notify affected customers and offer alternatives where possible.

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Refund Policy, and any signed Private Membership Association waiver, constitute the entire agreement between you and Newman Family Farm regarding your use of our website and services. These terms supersede any prior agreements or understandings, whether written or oral.

Changes to These Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the website after changes constitutes acceptance of the revised terms.
